These Terms & Conditions ("Terms") govern your use of peakdyn.com and the products operated by Peak Dynamics ERP, LLC ("Peak Dynamics", "we", "our", or "us"), including PeakForms, PeakForecast, and PeakPlatform (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

Peak Dynamics provides ERP software for field operations, including digital forms, offline data capture, scheduling, forecasting, and related tools for construction, drilling, industrial, agricultural, and field-service businesses. Features and availability may vary by product and account.

When using our Services, you agree to:

• Provide accurate information when creating an account or submitting data
• Keep your login credentials confidential
• Use the Services only for lawful business purposes
• Not attempt to disrupt, reverse engineer, or misuse the Services

By providing your mobile number and opting in, you agree to receive text messages from Peak Dynamics related to our Services. Our SMS program includes:

• Service updates and account notifications
• Payment disclosures, including notice at least 2 business days before any charge to a saved payment method

• Reply STOP at any time to cancel.
• Reply HELP for help.
• Message and data rates may apply.
• Message frequency varies.
• Carriers are not liable for delayed or undelivered messages.

The Services, including all software, text, graphics, and logos, are the property of Peak Dynamics ERP, LLC and its licensors. Nothing in these Terms grants you any right or license to our intellectual property except as needed to use the Services as intended.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or fully secure.

To the fullest extent permitted by law, Peak Dynamics ERP, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
